November 20, 2018. Today, the same Third Circuit panel of judges that heard oral argument in ANJRPC's magazine ban appeal on November 14 in Newark, N.J. heard "do-over" oral argument from the same counsel in Philadelphia, PA. The unusual repeat oral argument was requested by the Third Circuit after an extremely rare recording malfunction in last week's proceedings.
Argument for ANJRPC was once again handled by David Thompson, Esq. of the law firm of Cooper & Kirk, and argument for New Jersey was handled by the New Jersey Attorney General's office. The argument was largely a rehash of last week's proceedings, though the presentations for both sides were distinctly sharper the second time around.
The three-judge panel that heard the case again consisted of Judge Shwarz (appointed by President Obama), Judge Greenaway (appointed by President Clinton), and Judge Bibas (appointed by President Trump). Judge Greenaway did mention that the judges are aware of the time sensitivity involved and are working to render a decision as quickly as possible.
Several gun owners attended the proceedings in person.
With a December 10 compliance deadline looming under the new mag ban law, ANJRPC anticipates disseminating its analysis of how to comply with the new law, should that be necessary, as soon as the Third Circuit renders its decision, and possibly sooner.
