| APPEALS COURT ISSUES MIXED DECISION IN CARRY-KILLER CASE |
| September 10, 2025. The mid-level federal appeals court in ANJRPC's lawsuit to overturn New Jersey's carry-killer law issued a mixed ruling today, gutting large portions of the favorable judgment ANJRPC obtained from the lower court back in 2023. The appeals court upheld all of the specific so-called “sensitive place” carry bans (e.g. parks, beaches, museums, etc.) that the lower court had temporarily stopped. Importantly, however, the appeals court agreed that the carry ban on private property open to the public and the ban on carry in private vehicles could not stand. However, commuters should take special note that the appeals court allowed the carry ban on public transportation, blocking self-defense rights in one of the areas where they are needed most. But in a partial win for gun owners, the court found that the requirement that gun owners obtain liability insurance could not be enforced, and also found that at least $50 of the $200 permit application fee cannot be enforced. "It undermines the Constitutionally guaranteed right-to-carry, and this approach will ultimately wind up in the trash bin of history."
