| April 4, 2024. Oral argument of motions in the combined magazine ban and assault firearm ban cases at the lower federal court (for “summary judgment”) has been scheduled for Wednesday, April 10, 2024 at 11:00 a.m. at the U.S. District Courthouse in Trenton, located at 402 East State St., Trenton, NJ 08608. There will be no online broadcast of this event -- the only way to view it is in person at the courthouse. Summary judgment, if granted to the Plaintiffs, would have the effect of ending the cases in favor of gun owners.
ANJRPC’s magazine ban lawsuit was given new life in 2022 when the U. S. Supreme Court returned it to the lower federal court for reconsideration in light of the Bruen decision. Since then, the case has been tied up in a procedural tangle of court-ordered “discovery,” and became further complicated when it was consolidated with ANJRPC’s separate and more recent assault firearms law challenge. Discovery was completed late last year, after which ANJRPC filed the motions being argued on Wednesday.
In the meanwhile, both the mag ban and assault weapons ban issues continue to work their way through courts in other parts of the country. There are numerous similar cases being litigated, including in Delaware, Maryland, California, Oregon, and Illinois.
While there is no way to accurately predict how long it will take the court in ANJRPC's cases to make a ruling following Wednesday’s motions, it could be within several months. Whatever the court ultimately decides, these cases will almost certainly be appealed to the middle level federal appeals court following the ruling.
