ANJRPC MAKES FINAL ARGUMENT
TO U.S. SUPREME COURT
ON RIGHT TO CARRY!

New Legal Brief Is a Must-Read For All Gun Owners!
Brief Exposes in Plain English How States Like NJ Kill the Right to Bear Arms

July 15, 2021.  Today, ANJRPC made its final legal stand on the fundamental right to carry firearms for personal protection in a no-non-sense “friend of the court” legal brief filed with the U.S. Supreme Court in a New York State carry case headed to the high court later this year. This is the last opportunity to weigh in on carry before the Supreme Court rules.

See a copy of ANJRPC’s legal brief by clicking here.

In it, ANJRPC speaks poignantly for all gun owners whose Constitutional right to carry is actively suppressed by state and local governments that condition the exercise of that right on the whims of bureaucrats who rarely if ever allow it even in extreme cases.

ANJRPC’s brief is one of many “friend of the court” briefs being filed by various organizations as the case heads toward its historic conclusion.  The parties who brought the case have already briefed the core legal aspects of right to carry –

ANJRPC’s brief is like a legal “punctuation mark,” highlighting just how bad rights suppression can get, and how important a correct decision in the main case is.

The brief was authored by ANJRPC attorney Dan Schmutter.

Some key quotes from the brief:

“New Jersey firearms laws are a sledgehammer, pounding the life out of New Jerseyans’ fundamental constitutional rights.”

“Justifiable need is not justifiable.”

“The very concept of “need” is an unconstitutional sham.”

“New Jersey is proud of its record of rights suppression. New Jersey courts prominently cite to New Jersey’s stated goal to limit the use of firearms as much as possible.”

“Of all the courts to have relegated the Second Amendment to a second-class right . . . few have done it as thoroughly as the United States Court of Appeals for the Third Circuit.”

“The Third Circuit has simply stepped out of the way to allow New Jersey to trample the constitutional rights of its citizens.”

“A combination of legislative aggression and judicial permissiveness has rent large holes in the fabric of the Constitution.  This is what the fundamental constitutional rights of all Americans stand to look like if the judgment below is not reversed.”
