A long voting session included several gun bills that NRA-ILA testified against during the session.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;"></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">The Senate took final action, passing two problematic bills,&nbsp;</span><a href="https://pub.njleg.gov/Bills/2024/A5000/4974_I1.HTM" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.4974</a>&nbsp;<span style="color: #000000;">prescribing penalties for machine gun diversion devices utilizing a definition that is inconsistent with existing federal law and&nbsp;</span><a href="https://www.njleg.state.nj.us/bill-search/2024/A4976" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.4976a</a>&nbsp;<span style="color: #000000;">establishing the crime of reckless discharge which could potentially jeopardize situations of legitimate self-defense.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;"></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">The Governor signed&nbsp;</span><a href="https://www.njleg.state.nj.us/bill-search/2024/S1425" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">S.1425</a><span style="color: #000000;">, which expands culpability requirements for firearms trafficking offenses and violations of regulatory provisions relating to firearms. Having little to do with actual gun trafficking, this bill could potentially put dealers in legal jeopardy by second-guessing transactions already cleared by federal and state NICS checks.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;"></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">In a surprising move, Governor Phil Murphy issued a conditional veto of&nbsp;</span><a href="https://njleg.state.nj.us/bill-search/2024/A4978" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.4978</a><span style="color: #000000;">, which requires the Attorney General to report data regarding shootings that did not result in bodily injury. NRA-ILA opposed this bill as nothing more than an attempt to manipulate data for future use in pushing more gun restrictions. Ironically, the Governor’s conditional veto message sided with our argument that this would add cases that shouldn’t be included. Every firearm transfer through a licensed dealer must clear a state and federal background check before a gun can be released. How is it that a dealer “reasonably should know” something about a purchaser when the State itself tells the dealer it is OK to transfer the firearm? The bill passed the Assembly 47–25 and goes to the Governor.</span></p><p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif; text-align: justify;">&nbsp;</p><p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif; text-align: justify;"><a href="https://njleg.state.nj.us/bill-search/2024/A4975" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.4975</a><span style="color: #000000;">&nbsp;establishes the crime of possessing digital instructions to illegally manufacture firearms and firearm components. In 2018, Governor Phil Murphy signed legislation banning the use of these digital files. This bill is even worse, as mere possession of the files would result in harsh penalties, even if a person unknowingly “possesses” them on a long-forgotten old computer or email account. The bill passed the Senate 25–12 and will go to the Governor.</span></p><p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif; text-align: justify;">&nbsp;</p><p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif; text-align: justify;"><a href="https://njleg.state.nj.us/bill-search/2024/A4978" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.4978</a><span style="color: #000000;">&nbsp;requires the Attorney General to report data regarding shootings that did not result in bodily injury. This is nothing more than an attempt to manipulate data so it can be used to justify more firearm restrictions in the future. <title>THIRD CIRCUIT AGREES TO REHEAR “CARRY KILLER” APPEAL </title>

Platkin</span><span style="color: #000000;">, in front of the full panel of all 14 judges. This move wipes away the terrible decision of a three-judge panel earlier this year, and essentially represents a “do-over” of the appeal. The appeal will be reargued on February 11, 2026.<br /><br /></span></p><p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif; text-align: justify;"><span style="color: #000000;">This decision also reinstates the legal state of affairs that existed prior to the three-judge panel ruling. Until the full court rules, New Jerseyans will remain subject to the partial suspension of the carry killer law that went into effect in 2023 (see below for more details).<br /><br /></span></p><p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif; text-align: justify;"><span style="color: #000000;">That means that</span><span style="color: #000000;">for the duration of the new appeal</span><span style="color: #000000;">, the categories of place restrictions challenged in the lawsuit where gun owners can and cannot lawfully carry (NOTE: these are not complete lists) are as follows:<br /><br /></span></p><p style="color: #333333; The list now includes towns in seven counties across the Garden State. This joint initiative has been led by NRA,</span><span style="color: #000000;">New Jersey Firearm Owners Syndicate, and theCitizens Committee for the Right to Keep and Bear Arms.</span><br /><br /></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">Under NJ law, holders of a New Jersey permit to carry a handgun must pay $200 every two years, with $50 paid directly to the New Jersey State Police and $150 paid to the municipality that issues the permit. Those high fees were a result of New Jersey’s response bill to the 2022 landmark decision in the NRA-backed case ofNYSRPA v. Bruen. NJ’s so-called ‘carry killer bill’ that was passed in December of 2022 quadrupled those fees from the pre-Bruenlevels. In addition, the bill attempted to declare nearly the entire state a gun-free zone. These high fees are a central part of NRA’s case against the NJ Attorney General,&nbsp;</span><a href="https://www.courtlistener.com/docket/67401781/ronald-koons-v-attorney-general-new-jersey/" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">Siegel v. Platkin</a><span style="color: #0000ff; font-weight: bold;">.<br /></span><br /></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">In September, a three-judge panel of the Court of Appeals for the Third Circuit ruling on Siegel,</span><a href="https://www.courtlistener.com/docket/67401781/153/ronald-koons-v-attorney-general-new-jersey/" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">struck down the $50 portion of New Jersey’s carry permit fee</a>&nbsp;<span style="color: #000000;">on the basis that the purpose of the fee likely failed “to meet the expense incident to the administration of the [licensing] Act and to the maintenance of public order in the matter licensed.” Beginning in June of this year, towns across the Garden State have started rejecting the state-mandated municipal portion of fees on the grounds that they are redundant and far exceed what is necessary to process an application.<br /></span><br /></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">With the addition of Howell, in just the towns that have passed this resolution so far, over $125,000per yearin exorbitant and unconstitutional fees have been eliminated, and with nearly 200,000 people living in those municipalities, a growing percentage of the population of the state now lives in places free of these financial barriers to exercising a core constitutional right.<br /></span><br /></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">The list of towns now includes: Englishtown (Monmouth County), Franklin Borough (Sussex County), Dumont (Bergen County), Hardyston (Sussex County), Hopatcong (Sussex County), Vernon (Sussex County), Cresskill (Bergen County), Butler (Morris County), Medford Lakes (Burlington County), Readington (Hunterdon County), Beachwood (Ocean County) and now Howell Township (Monmouth County).<br /></span><br /></p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000;">This project has largely been accomplished through a grassroots initiative. text-align: justify; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; text-align: justify; font-family: 'Times New Roman', serif;">She will become New Jersey’s first female Democratic Governor.</span><span style="font-size: 13pt; text-align: justify; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; text-align: justify; font-family: 'Times New Roman', serif;">Sherrill’s victory also marks the first time a Democrat has won election following a two term Democrat Governor since Governor Hughes victory in 1961.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">She will enter the office in January 2026 with solid majorities in the Legislature.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Time will tell where political realities will take her Administration as her party swings further left on election night around the nation.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Her Republican opponent, Jack Ciattarelli, ran a textbook campaign.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">He was constantly on-message on issues that seemed to be resonating with New Jersey residents on affordability, taxes and the direction of the State.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Following his near miss loss against Governor Murphy in 2021 there was enthusiasm around his candidacy that he could drag New Jersey back to being a competitive State for the GOP.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;"></span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">But what voters say before an election and what they do with their ballots are two different things.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Jack’s constant retail campaigning was simply not enough to compete with what the Democrats bring to the table on election day.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">While Sherrill ran what has been described even by Democrats as a lackluster campaign, she had the benefit of New Jersey Democrats political infrastructure and independent voters dislike of Donald Trump putting wind in her sails. </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;"></span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">She also carries with her a tremendous resume that she touts wherever she goes – veteran, pilot, mom.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Voters clearly liked what they saw as she is on pace for a blowout electoral victory when most pundits and polls had the race as tight.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">The real winner of the evening may be the Democrat Get Out the Vote operation.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">The Democrats early voting operation and their more than 800,000 registered vote advantage are akin to giving them a 20 yard lead in a 100 yard dash.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">While Republicans did a far better job turning out early voters this year they simply could not make up the lead the Democrats had going into the election.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;"></span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">This vote banking can’t be understated.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">In addition to boosting the Sherrill campaign it very likely protected Democratic Assembly members in Trump leaning counties that Ciattarelli won in 2021.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">In addition to their early vote prowess, Democrats also benefited from high turnout in Jersey City from their contests Mayoral race and the GOTV operation in the rest of Democratic Hudson and Essex Counties specifically.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">There will be more analysis needed over the next few days and with it plenty of questions about the results will be answered.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;"></span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Specifically, why did voters who felt the State was heading in the wrong direction continue with the same party to lead it?</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">How did President Trump impact the race – did voters choose Democrats to protest him; did Trump voters stay home; was there no carry over from minority voters from Trump in 2024 to Ciattarelli in 2025?</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Is there any path in the future for a Republican to win Statewide in New Jersey again?</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; font-family: 'Times New Roman', serif;">But for now, we know the 2025 election has yielded a commanding victory for Mike Sherrill, a continuation of Democratic control in the Legislature and a brand-new Administration will be moving into Trenton soon.</span></p> <p style="text-align: justify;"><b><u><span style="font-size: 13pt; font-family: 'Times New Roman', serif; color: #ee0000;">Sherrill Coattails Expand Democratic Assembly Majority</span></u></b></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">The Democratic wave that crashed into New Jersey also swept the Democrats into an even larger majority in the General Assembly.<span>&nbsp; </span>The Assembly Democratic majority will expand to at least 55 members as they knocked at least 3 Republican incumbents out of their seats.<span>&nbsp; </span>They may not be done, however, as at least 4 other GOP incumbents were in races too close to call into the early morning.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Districts 3 and 4 are centered in Counties won by Ciattarelli in 2021 and Trump in 2024.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">But Mikie Sherrill and the Democratic machine had coattails the GOP candidate couldn’t match.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Not only did every Democratic incumbent win but the GOP saw incumbent Assemblyman Mike Torrissi in District 8 and Assemblywomen Nancy Munoz and Michelle Matsikoudis in District 21 lose their seats.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">What was predicted to be a dogfight for Assembly seats held by Democratic incumbents in District 16, 36 and 38 never materialized.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;"></span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Regardless of whether the Democrats pull off a win for the four seats too close to call in District 2 and 25 they will hold the largest Assembly majority either party has held since the GOP had 58 seats after the 1991 election.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;"></span></p> <p style="text-align: justify;"><b><u><span style="font-size: 13pt; font-family: 'Times New Roman', serif; color: #ee0000;">What Happens Now?</span></u></b></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">What is clear is that Democrats are in undisputed control of Trenton for the next two years.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">With that comes the ease of governing with votes to spare in the Senate and Assembly and a Governor who will be on a mission to deliver on promises made during the campaign.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">While it may win votes to run against Donald Trump though New Jersey residents still say high taxes and affordability are their most pressing concerns.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Voters have now provided the Democrats the power and the time to address those issues.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Governor-elect Sherrill will now be tasked with establishing a transition team to focus on her Administration’s priorities.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">Sherrill, who has never held a State or local office before becoming Governor, will also need to appoint a senior staff and Cabinet with experience to help her run New Jersey on a day-to-day basis.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">She will likely want to be well prepared for her inaugural speech, quickly followed by the February Budget message, to make it clear what her term in office will be all about.</span></p> <p style="text-align: justify;"><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">While that is ongoing, the current Legislature will need to finish the legislative session.</span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">&nbsp; </span><span style="font-size: 13pt; font-family: 'Times New Roman', serif;">The Legislature has been on recess since the end of June and there are likely dozens of bills they want to get on the Governor’s desk before the session ends in January.</span><span style="font-size: 13pt;                     <p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif;"><a href="https://www.njleg.state.nj.us/bill-search/2024/A4975/bill-text?f=A5000&amp;n=4975_R1" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.4975</a>&nbsp;<span style="color: #000000;">creates a crime for possession of digital instructions to illegally manufacture firearms or firearm components. This legislation creates a crime even if someone never actually produces a gun or component. Simply having a digital file for a component on your computer will result in a presumption that you intended to illegally manufacture, and it will turn innocent gun owners into criminals.</span></p>
                    <p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif;">&nbsp;</p>
                        <p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif;"><a href="https://www.njleg.state.nj.us/bill-search/2024/A4976/bill-text?f=A5000&amp;n=4976_R1" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.4976</a>&nbsp;<span style="color: #000000;">establishes the crime of reckless discharge. Discharging a firearm in New Jersey is already illegal unless done “for a lawful purpose,” which is an affirmative defense. This is nothing more than a swipe at concealed carry. Now, every time a firearm is used, even in legitimate self-defense situations, prosecutors will have more tools to harass law-abiding gun owners. There is also no exception for accidental discharges, and last-minute amendments yesterday presume that self-defense use of firearms is unlawful and place the burden on honest gun owners to prove that their conduct ina self-defense situation was legal.</span></p>
                        <p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif;">&nbsp;</p>
                            <p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif;"><a href="https://www.njleg.state.nj.us/bill-search/2024/A1389/bill-text?f=A1500&amp;n=1389_R1" rel="noopener noreferrer" target="_blank" style="color: #0000ff; background-color: transparent; font-weight: bold;">A.1389</a>
                                <span style="color: #000000;">requires confiscation of ammunition and firearms components in response to domestic violence restraining orders or convictions. This bill applies to accusations, even false accusations, not just convictions. Current law
                                    already requires confiscation of firearms, but this bill is absurd as it would now require confiscation of components like spare grips, scope caps, cleaning kits, choke tubes, holsters and slings.</span>

                            <p style="color: #333333; margin: 0px; padding: 0px; font-size: 16px; font-family: 'Times New Roman', Times, serif;">&nbsp;</p>

                                <span style="color: #000000;">mandates the use of Merchant Category Codes. This is nothing more than government sanctioned snooping that can be used to create a firearms registry or discriminate against gun owners and lawful businesses.</span>

The hearing started an hour and a half late as they fumbled with amendments to “fix” the bills. There was legislation impacting the Attorney General and law enforcement, but committee members admitted they consulted neither. Second Amendment groups? They did not bother to talk to them either. NRA State Director Darin Goens and ANJRPC lobbyist Rob Nixon testified against the bills, pointing out that these bills are unnecessary and deeply flawed.&nbsp; Republican committee members Assemblyman Robert Auth (R-39) and Assemblywoman Victoria Flynn (R-13) did a terrific job questioning the bills and supporting law-abiding gun owners. This legislation creates a crime even if someone never produces a gun or component. Simply having a digital file for a component on your computer makes you a criminal.&nbsp;</span></span></p><p style="box-sizing: border-box; margin: 0px 0px 10px;"><span style="box-sizing: border-box; font-size: 16px;"><span style="box-sizing: border-box; font-weight: 700;"><span style="box-sizing: border-box; line-height: 17.12px; font-family: 'Times New Roman', serif;"><a href="https://pub.njleg.state.nj.us/Bills/2024/A5000/4976_R1.PDF" target="_blank" style="box-sizing: border-box; background-color: transparent; text-decoration-line: none;">A.4976</a></span></span><span style="box-sizing: border-box; line-height: 17.12px; font-family: 'Times New Roman', serif;">&nbsp;establishes the crime of reckless discharge. Discharging a firearm in New Jersey is already illegal unless done “for a lawful purpose,” which is an affirmative defense. This is nothing more than a swipe at concealed carry. Now, every time a firearm is used, even in legitimate self-defense situations, prosecutors will have more tools to harass law-abiding gun owners. Bush lost New Jersey by 6%.&nbsp;Put into recent historical context, Trump’s margin of loss is a result New Jersey Democrats should ignore at their peril.&nbsp;Trump lost New Jersey in 2020 by 16% and by 14% in 2016.&nbsp;Romney lost the State by 18% in 2012 while McCain lost it by 16% in 2008.&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The results likely will tell two stories: one that is generic to most national races and one that is Trump related.&nbsp;First, voters in New Jersey and around the nation have been impacted by higher inflation, wages not keeping up with costs and skyrocketing living expenses during the Biden Administration.&nbsp;As Bill Clinton said, “It’s the economy, stupid.”&nbsp;Concerns about affordability is often a bad sign for a party trying to hold the White House in any election and Trump had the ability to compare those dismal economic numbers of the last four years to his first term.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Second, Donald Trump has connected with segments of the voting population that Democrats can’t afford to lose – high school educated white males, black and Latino voters and young people.&nbsp;Exit polling around the country showed Donald Trump overperforming in those demographics while Vice President Harris could not match the numbers President Biden scored with those groups in New Jersey and the battleground States.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">And while Trump had no Congressional coattails in the State, his increase in his share of the vote total did make for some closer than expected elections in Democratic districts and counties.&nbsp;But more importantly for New Jersey Democrats this is the second single digit Statewide win for them in a row.&nbsp;It begs the questions of whether a candidate other than President Trump could have won New Jersey in this economic environment and whether this says anything about voters going into the 2025 Gubernatorial election.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The dust still needs to settle and it’s true that no two elections are exactly alike but there were some major cracks in the Democratic wall for the second statewide election in a row.&nbsp;For example, county and local GOP candidates won or came close in races from Bergen to Cumberland County.&nbsp;Whether that is economy related or is part of the Trump effect is yet to be analyzed it can be certain both parties will be looking for clues as to what appealed to voters in 2024 looking ahead to 2025.</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px;"><span style="color: #d73333; font-size: 18px; font-weight: bold; font-style: italic;">Andy Kim Elected U.S. Senator</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">In the State’s other Statewide race, three term Congressman Andy Kim has bested Republican businessman Curtis Bashaw to become New Jersey’s next U.S. Senator.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Kim’s path to the Senate was unusual from the start in a State that does not replace its Senators often.&nbsp;Soon after the indictment of Senator Bob Menendez, Congressman Kim took the bold move to demand his resignation from the Senate while declaring his candidacy for the seat.&nbsp;In doing so he set off a chain reaction of events that led to his election as New Jersey’s next U.S. Senator while fundamentally changing the way primary elections are conducted in New Jersey along the way.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The story of Kim’s ascension to the Senate will forever be defined for his challenge of New Jersey’s longstanding “party line” ballot process whereby Democratic and GOP candidates received favorable and exclusive ballot positions determined by county political party leadership.&nbsp;When the party establishments began to rally around First Lady Tammy Murphy in the leadup to the primary election Kim challenged the process in Federal Court as unconstitutional.&nbsp;The challenge not only succeeded in pushing Murphy out of the race but it led to a judge siding with Kim and forcing the State to abandon the party driven process in favor of a yet to be determined “block voting” choice.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Interim U.S. Senator George Helmy, who was chosen by Governor Murphy to fill the vacancy caused by the Menendez resignation, is expected to step down after the vote is certified to allow Kim to enter the Senate before this term is over.</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px;"><span style="color: #d73333; font-size: 18px; font-weight: bold; font-style: italic;">Kean holds on in District 7</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Congressional races in New Jersey are, by design of gerrymandering, predictable affairs as the seats are drawn to favor one party over another.&nbsp;The 7th Congressional District stands as the one place in the State that defies that easy predictability.&nbsp;Since his election in 2022 GOP Congressman Tom Kean, Jr. has had a target on his back by national Democrats who desperately need the suburban NY area District to regain their control of the House.&nbsp;Kean, a policy and constituent focused legislator, however was able to beat back a challenge from Democrat Sue Altman to secure his reelection.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Democrats hoped an anti-Trump vote could carry Altman to victory.&nbsp;But Kean is a well know commodity in his District after years as a State Senator and as son of the still popular former New Jersey Governor.&nbsp;Unlike Members of Congress who seek attention or social media clicks, Kean was able to personalize his reelection on more local, impactful issues like crime and affordability as Democrats fought hard to tie him to Trump, national GOP politics and hot button issues.&nbsp;Kean’s reelection is a major win for the State and national GOP.</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px;"><span style="color: #d73333; font-size: 18px; font-weight: bold; font-style: italic;">Congressional Delegation cruises and welcomes new Members</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The remainder of the House races concluded as expected.&nbsp;Congressmen Norcross, Van Drew, Smith, Pallone, Menendez and Gottheimer and Congresswomen Watson Coleman, Sherrill and McIver were all easily reelected.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">New Jersey voters will be sending 2 new Members to Congress next term however.&nbsp;Democratic Assemblyman Herb Conaway was elected in the Third District to replace Andy Kim.&nbsp;Democratic Senator Nellie Pou was chosen to replace the late Congressman Bill Pascrell in the 9th District.&nbsp;&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The election of Conaway and Pou necessitates their replacement in the Assembly and Senate respectively.&nbsp;It will also lead to a shuffle to replace them as Chair of two important legislative Committees – Conaway’s Assembly Health Committee and Pou’s Senate Commerce Committee.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The partisan split in the Congressional Delegation will remain 9-3 in favor of the Democrats when the new Congress is sworn in in January.</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px;"><span style="color: #d73333; font-size: 18px; font-weight: bold; font-style: italic;">The 2025 Election starts today!</span></p><p style="margin: 0px; padding: 0px;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">New Jersey voters won’t have a chance to catch their breaths very long once the dust settles on the 2024 election.&nbsp;New Jersey is one of the rare States in the nation that conducts its statewide election in “off years” separate from federal elections.&nbsp;As such, the State will be choosing a Governor and 80 members of the General Election next November.&nbsp;&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Governor Phil Murphy is term limited and the race to replace him is well underway.&nbsp;Democrats already in the race include former Senate President Steve Sweeney, Jersey City Mayor Steve Fulop, Newark Mayor Ras Baraka and NJEA President Sean Spiller.&nbsp;With the election over it is also expected that Congresswoman Mikie Sherrill and Congressman Josh Gottheimer will be entering the race to succeed Murphy as well.&nbsp;While a number of major Democratic State and county political party leaders have endorsed Sherrill at this stage it is way too early to say anyone is the favorite.&nbsp;&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Republicans are also getting a head start on 2025 with Jack Ciattarelli, who came within 3 points of winning the 2021 race, NJ 101.5 personality Bill Spadea and State Senator Jon Bramnick already campaigning for GOP support to become the nominee.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">It would be an oversimplification to compare New Jersey’s presidential voting habits with their Governor race picks.&nbsp;While New Jersey hasn’t supported a Republican for President since 1988 in that same time voters have elected and then reelected two Republican Governor’s.&nbsp;Democrats, despite nearly a million vote registration advantage and great party organization leadership simply can’t overlook history, Trump’s success with minorities and working class voters and the shocking closeness of the 2021 Governor’s race.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">And while elections are about issues and how people are feeling at a particular moment, they are also about individuals whose names are on the ballot.&nbsp;Therefore, both parties have a stressful few months of candidate selection ahead of them to ensure the party nominees match both the moment and the issues without assuming anything about past performance and New Jersey being a “blue” State.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The undercard of the 2025 race will feature the 80-member General Assembly.&nbsp;And while legislative districts are designed to maintain the status quo, much like our Congressional Districts, a number of factors could impact the current Democrat Assembly majority.&nbsp;For example, more than one quarter of the Assembly were newly elected in 2023 and they are still building their name ID to voters.&nbsp;A number of these are in areas where President Trump and 2021 GOP Governor candidate Ciattarelli did surprisingly well such as Gloucester, Bergen and Passaic County.&nbsp;&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #d73333; font-size: 18px; font-weight: bold; font-style: italic;">Ballot Reform will change the political landscape in 2025&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Complicating the math for every candidate in both parties is the change to the way primary ballots will be structured in 2025.&nbsp;As mentioned above, Andy Kim’s successful challenge to the “party line” voting process necessitated a change to the way voters will be presented the GOP and Democratic candidates in primary elections.&nbsp;While Senator-elect Kim and progressive advocates are arguing that the ballots should simply throw all qualified candidates into an “office block” style and let voters pick from there, some legislative and party leaders feel it would be less chaotic to build a hybrid ballot that blends the old and new methods together.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Specifically, “office block” voting means if there are 12 candidates running for 2 Assembly seats in the primary that all 12 names are placed into one “block” on the ballot with the names in randomly selected order.&nbsp;Before the Kim lawsuit changed the primary election process, New Jersey used a “party line” selection whereby county political parties placed their “favored” candidates in one line with any other candidate being placed on a separate line elsewhere in the ballot.&nbsp;So if a person was running for Governor but had a limited or no State, county or local candidates to bracket with that person could find themselves far away on the ballot from the party endorsed candidates.&nbsp;While not impossible, beating “the line” was a huge mountain for candidates to climb.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">To address the uncertainty caused by the court ruling on ballot design, Assembly Speaker Coughlin has created a bipartisan Assembly Committee to review and make recommendations for how to implement the court’s mandate.&nbsp;Co-Chaired by Republican Assemblyman Al Barlas and Democratic Assemblyman Benjie Wimberly, the Committee has already begun analysis and public hearings on what the office block primary ballot would look like.&nbsp;Several options are expected to be proposed from simply throwing all names into each office block to allowing candidates to bracket together within the block to let running mates for offices appear with each other.&nbsp;&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">The implications of this are huge.&nbsp;First, if a half a dozen Democratic candidates for Governor all run their own slate of candidates for Assembly there could be 12 people in one block seeking 2 seats in each District.&nbsp;This could lead to chaos for incumbent candidates who, in many cases, are not household names.&nbsp;In any scenario, it could lead to candidates from two different slates being chosen by voters while the Governor’s candidate they ran with could fail themselves to be selected.&nbsp;This will not only change the face of the Legislature but it could lead to some level of personal discomfort between running mates if a race becomes nasty between primary election winners.</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Second, and on a related note, this could have massive fundraising implications for both parties as it will cost an untold amount of money to identify incumbents and party favored candidates within a block.&nbsp;&nbsp;</span></p><p style="margin: 0px; padding: 0px; text-align: justify;">&nbsp;</p><p style="margin: 0px; padding: 0px; text-align: justify;"><span style="color: #000000; font-size: 17px;">Finally, the office block voting process could have the effect of strengthening county political parties fundraising and Get Out The Vote operations by focusing their efforts on candidate selection and identification.</span></p><p style="margin: 0px;
